If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the website or request services.
Website use is also subject to our Privacy Policy. Specific service engagements may be governed by a separate written proposal, statement of work, or service agreement, which controls if there is a conflict with these website Terms.
2. Services
We provide professional publishing-related services that may include, without limitation: manuscript consultation, ghostwriting support, editing and proofreading, cover design, formatting, print/ebook/audiobook production guidance, distribution support, and book marketing services.
Service descriptions on the website are for general information. Scope, timeline, deliverables, fees, and revision allowances are confirmed in writing for each engagement. We do not guarantee bestseller status, specific sales volume, retailer acceptance in every channel, or particular marketing outcomes.
3. Website use & acceptable conduct
You agree to use the website only for lawful purposes. You must not:
- Attempt to gain unauthorized access to our systems, forms, or data;
- Submit false, misleading, or fraudulent information;
- Upload or transmit malware, spam, or harmful code;
- Scrape, copy, or reuse site content for commercial purposes without written permission;
- Interfere with site security, performance, or other users’ access.
We may suspend or restrict access for suspected misuse, abuse, or security risk.
4. Consultations, quotes & contracts
Submitting a form or requesting a quote does not create a service contract. A binding engagement begins only when both parties agree in writing (including email confirmation of a proposal) and any required deposit or payment terms are met, unless otherwise stated.
Quotes are based on information you provide. If project scope changes (length, complexity, rush timelines, additional formats, or extra revision rounds), fees and schedules may be adjusted with notice.
5. Payments, refunds & cancellations
Fees, payment schedules, and accepted methods are stated in your proposal or invoice. Work may be paused if payments are overdue. Unless a written agreement states otherwise:
- Deposits and fees for work already performed are generally non-refundable;
- Cancellation requests must be submitted in writing;
- Completed milestones remain billable;
- Third-party costs (ISBN, printing samples, ads, stock assets, narration talent, etc.) may be non-refundable once incurred.
Chargebacks initiated without first contacting us to resolve a billing concern may result in suspension of services and collection of amounts due.
6. Intellectual property
Website materials: The site’s design, text, graphics, logos, and original content are owned by Marketing And Publishing Studio LLC or its licensors and are protected by intellectual property laws. You may not copy or redistribute them without prior written consent, except for personal, non-commercial viewing.
Author materials: Subject to payment of applicable fees and the terms of your service agreement, you generally retain ownership of your manuscript and original creative content. We may retain a limited license to use project materials as needed to perform services and, with your permission, for portfolio or testimonials.
Templates, processes, tools, and proprietary workflows we use remain our intellectual property unless expressly assigned in writing.
7. Author content & warranties
You represent and warrant that:
- You own or have all rights necessary to submit materials for editing, design, publishing, or marketing;
- Your content does not infringe copyrights, trademarks, publicity, privacy, or other rights of any third party;
- Your content is not unlawful, defamatory, or otherwise prohibited;
- Information you provide for listings, biographies, and marketing is accurate to the best of your knowledge.
You are responsible for reviewing proofs and approving final files before publication or distribution. Once you approve deliverables, further changes may be billed as additional work.
8. Disclaimers
The website and informational content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.
Publishing and marketing involve factors outside our control (retailer policies, algorithms, market conditions, advertising platforms, and reader response). Any examples, case studies, or testimonials are illustrative and not guarantees of similar results.
9. Limitation of liability
To the maximum extent permitted by applicable law, Marketing And Publishing Studio LLC and its officers, employees, and contractors shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising from website use or services, even if advised of the possibility of such damages.
Our aggregate liability arising out of or related to a service engagement shall not exceed the fees you actually paid to us for that specific engagement during the three (3) months preceding the claim, except where liability cannot be limited by law.

You agree to indemnify and hold harmless Marketing And Publishing Studio LLC and its team from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your breach of these Terms, or your violation of any law or third-party rights, except to the extent caused by our willful misconduct.
11. Governing law & disputes
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles. Exclusive venue for disputes arising from website use or these Terms shall be the state or federal courts located in Georgia, unless a separate service agreement specifies otherwise.
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
